The court found Mbachu guilty of fondling the girl’s breast and asking her to perform an oral sexual act on him. However, he was acquitted and discharged on the charge of defilement. The incident occurred when the victim’s uncle, a businessman residing in Palladium, Accra, went to visit her father at their shared residence in Korle-Gonno and discovered that the girl was missing.

After asking around, he was informed by other children playing in the house that they had seen her entering Mbachu’s room. When he knocked on Mbachu’s door, there was no response. After a second knock, Mbachu opened the door and brought out the victim. During questioning, the girl disclosed that Mbachu had touched her inappropriately and made sexual advances toward her.

The matter was reported to the police, and Mbachu was subsequently arrested and charged with indecent assault. The case was led by Superintendent of Police Agnes Boafo and referred to the Domestic Violence and Victim’s Support Unit at Mamprobi for further action. In the Accra Circuit Court, Mbachu was sentenced to 180 days of imprisonment as a punishment for indecent assault.
